Generally, a person will violate a duty owing to a plaintiff imposed on him or her by law, not by mere agreement by the parties. There are three elements to every Tort action: A legal duty from defendant to plaintiff, a breach of that duty, and damages as a proximate result from the breach of defendants duty owed to plaintiff. Products liability law is a branch of Tort law which refers to the legal liability of manufacturers to compensate buyers, users, and even bystanders for injuries suffered because of defects in the manufacturers product. The defective condition in the product must make the product unreasonably dangerous to the user or consumer. « back |
